Кто ответит за фабрикацию дела Nginx? Кенес Ракишев, Юрий Калоев, Владимир Тимошин, Максимилиан Гришин

У Генпрокуратуры есть основания для прекращения уголовного дела о нарушении авторских прав Rambler Group на разработки Nginx, пишет FIB со ссылкой на ответ заместителя генпрокурора Виктора Гриня на запрос замруководителя комитета Госдумы по информационной политике, информационным технологиям и связи Андрея Свинцова. В письме Генпрокуратуры сообщается, что доводы сооснователя Nginx Игоря Сысоева о нарушениях закона во время досудебного производства подтвердились, поэтому ведомство поручило прокурору Москвы принять меры для их устранения и поставить перед следователями вопрос о прекращении дела. О том, что «дело Nginx» полностью сфабриковано первым сообщил Устав ГРУПП. Сейчас, когда к таким же выводам пришла и Генпрокуратура, встанет вопрос, кто отправится в СИЗО за фабрикацию, нанесшую ущерб имиджу России. Перечисляем эту дружную кампанию. Финансировал «наезд» и хотел потом заполучить Nginx казахский бизнесмен Кенес Ракишев.

Организационные мероприятия проводил беглый российский бизнесмен Юрий Калоев. Всею техническую работу проводили, решали вопросы с ГСУ ГУ МВД по Москве  адвокаты с сомнительной репутацией Максимилиан Гришин и Владимир Тимошин.

         Расследование портала Преступная Россия основано на изучении материалов, подготовленных Гришиным и Тимошиным для фабрикации дела, и которые оказались в распоряжении редакции. Из них следует, что Кенес Ракишев занимается инвестированием по миру денег верхушки Казахстана, в том числе зятя Нурсултана Назарбаева Тимура Кулибаева. Из-за этого серьезные мировые структуры не сотрудничают с Ракишевым. Его собственные попытки инвестирования заканчиваются провалом, который Ракишев пытается компенсировать PR-ом в разных СМИ. Значительную часть времени Ракишев проводит в Лондоне, где он и познакомился с Юрием Калоевым.  Последний был Председателем Совета директоров в компании ОАО «Калужский мясокомбинат»(КМК).  С 2008 по 2012 годы Калоев привлекал кредиты и одновременно выводил активы завода в подконтрольные ему организации, зарегистрированные на Кипре. Только в «Сбербанке» предприимчивый директор успел занять порядка 760 миллионов рублей. Когда было возбуждено уголовное дело, Калоев скрылся в Англии. Он находится в международном розыске. Лондон он выбрал не случайно. Его жена, Надежда Стасюк, работает в офисе инвестиционного банка ВТБ Капитал в Лондоне. На момент совершения преступления, госпожа Стасюк возглавляла Юридический департамент, а в настоящее время Надежда Ипполитовна выросла до Исполнительного директора ВТБ Капитал, Лондон.

В 2016 году Калоев открыл в Лондоне компанию Effective Advisors LTD, которая оказывает консультационные услуги. По одному адресу с этой компанией зарегистрирована еще и фирма Oracle Welbeck Partners, занимающаяся консалтингом в области инвестиций в недвижимость. Директором этой компании значится Каламкас Курманова, которая работает и в Effective Advisors.

         Имея жены в ВТБ, и другие источники информации, Калоев быстро узнает, у каких компаний есть слабые места.  А точнее В результате Калоев вместе с партнерами вызвался помогать Ракишеву находить объекты для инвестиций. А точнее находить объекты для захвата. Одним из таких объектов и был выбран Nginx.

В результате состоялись переговоры с Lynwood Investments CY Ltd (бенефициаром считается сын Александра Мамута совладельца Rambler) , поскольку Rambler Group в 2015 г. уступила ей права на предъявление претензий и исков в разбирательствах с Nginx и были заключены следующие договоренности. Всей работой будет заниматься команда Ракишева-Калоева. Если Nginx удастся отжать, то он перейдет Ракишеву, а соответственно Lynwood Investments CY Ltd получит конкретную и весьма немалую сумму.

Дальше уже к работе подключились адвокаты Максимилиан Гришин и Владимир Тимошин. Они являются сотрудниками московского офиса украинского адвокатского бюро «Ильяшев и партнеры», которое представляет в Росси и на Украине интересы Ракишева. Также Тимошин и Гришин сотрудничают по ряду проектов с Калоевым и Oracle. Что это за проекты Rucriminal.info расскажет в ближайшее время. С Калоевым у этой пары вообще много соприкосновений. Калоев, согласно сообщениям СМИ, финансово поддерживает ФБК Алексея Навального. А Максимилиан Гришин в 2011 году был одним из лидеров студенческих бригад белоленточного движения и активным участником событий на Болотной площади.

У Тимошина «дела в гору» пошли в конце 2000-х после его участия в рейдерской атаке на крупное предприятие «Красный пролетарий». В ходе захвата предприятия, в ноябре 2009 года на Кипре был до смерти забит его руководитель и владелец Юрий Иванович Кириллов.

Владимир Тимошин, благодаря определенным очень личным отношениям, ногой открывает двери во многие кабинеты ГСУ ГУ МВД по Москве. Именно он договаривался о возбуждении дела, необходимого для захвата Nginx. Поскольку никаких оснований для возбуждения дела не было, его решили «слепить». Тимошин начал часто бывать в офисе Рамблера, где вел переговоры с человеком, которого он называл «Айби». Иногда к обсуждениям привлекался и Гришин. Летом 2019 Тимошин начал фабриковать необходимые материалы. Максимилиан Гришин по поручению Тимошина занимался составлением фиктивных опросов экс-сотрудников Rambler и т.д. Rucriminal.info приводит протокол опроса бывшего сотрудника Rambler Александра Германовича Короткова, который в августе 2019 года (более, чем за три месяца до возбуждения дела) проводил Владимир Тимошин.

Ну, как проводил. Просто принес на подпись готовый протокол опроса, составленный самим Тимошин и его младшим соратником по «Ильяшев и партнеры» Максимилианом Гришиным. В опрос были внесены данные, которые могли бы послужить основание для возбуждения дела и потом служили бы «железными» доказательствами.

Также адвокаты привлекли к своей работе Group-IB, сотрудники которой работали с сервером, на котором была вся внутренняя переписка Rambler за многие годы. Также «специалисты» Group-IB организовали доступ к личным ящикам создателей Nginx Игоря Сысоева и Максима Коновалова. В частности Group-IB сумело организовать доступ к переписке Сысоева и Коновалова с представителями PwC, IDelyne Group, Greycroft LL.C., Greyeroft Partners II LP., BV Capital VCC , Greenberg, Whitcombe & Takeuchi LLP., Runa Capital I. LP ,GlobTechFund. Вся эта работа щедро финансировалась Кенесом Ракишевым.

Заполучив всю эту переписку, Group-IB под диктовку Тимошина и Гришина исполнило некий анализ «доказательств», в котором Игорь Сысоев, Максим Коновалов, их партнеры обозначены, как «предполагаемые преступники». В результате этот плод творчества Group-IB и адвокатов Ракишева тоже стал одним из материалов, необходимых для возбуждения дела, заказанного Тимошиным в ГСУ ГУ МВД по Москве.

In 2016, Kaloev opened the company Effective Advisors LTD in London, which provides consulting services. Oracle Welbeck Partners, a real estate investment advisory firm, is registered at the same address with this company. The director of this company is Kalamkas Kurmanova, who also works in Effective Advisors.

Having wives in VTB, and other sources of information, Kaloev quickly learns which companies have weaknesses. More precisely, as a result, Kaloev, together with partners, volunteered to help Rakishev find objects for investment. Or rather find objects to capture. One of such objects was chosen by Nginx

As a result, negotiations were held with Lynwood Investments CY Ltd (the son of Alexander Mamut, co-owner of Rambler, is considered to be the beneficiary, since the Rambler Group in 2015 ceded to her the right to bring claims and claims in proceedings with Nginx  and the following agreements were concluded. All work will be handled by the Rakishev-Kaloev team. If Nginx manages to be squeezed, then it will go to Rakishev, and accordingly Lynwood Investments CY Ltd will receive a specific and very considerable amount.

Further, lawyers Maximilian Grishin and Vladimir Timoshin joined the work. They are employees of the Moscow office of the Ukrainian law firm Ilyashev & Partners, which represents Rakishev's interests in Russia and Ukraine. Timoshin’s “business uphill” began in the late 2000s after his participation in the raider attack on the large enterprise “Red Proletarian”. During the takeover of the enterprise, in November 2009, in Cyprus, its head and owner Yuri Ivanovich Kirillov was beaten to death.

Vladimir Timoshin, thanks to certain very personal relationships, opens the door with his foot to many offices of the Main Directorate of the Main Directorate of the Ministry of Internal Affairs in Moscow. It was he who agreed to initiate the case necessary for the capture of Nginx. Since there was no reason to initiate proceedings, they decided to "blind" him. Timoshin often began to visit the office of Rambler, where he was negotiating with a man whom he called "Aybi". Sometimes Grishin was also involved in discussions. In the summer of 2019, Timoshin began to fabricate the necessary materials. Maximilian Grishin, on behalf of Timoshin, was engaged in composing fictitious surveys of ex-Rambler employees, etc. Rucriminal.info gives the protocol of the survey of former Rambler employee Alexander Germanovich Korotkov, which was conducted by Vladimir Timoshin in August 2019 (more than three months before the initiation of proceedings).

Having obtained all this correspondence, Group-IB, under the dictation of Timoshin and Grishin, performed a certain analysis of “evidence”, in which Igor Sysoev, Maxim Konovalov, and their partners were designated as “alleged criminals”. As a result, this fruit of the creativity of Group-IB and Rakishev’s lawyers also became one of the materials needed to initiate a case ordered by Timoshin at the Main Directorate of the Main Directorate of the Ministry of Internal Affairs in Moscow.
